The petitioner is languishing in custody since 18.03.2017 in connection with Cheriabariarpur P.S. Case No. 13 of 2017 for the offences instituted under Sections 363 and 366(A)/34 of the IPC.
The prosecution story, in brief, is that the petitioner has enticed away the minor daughter of the informant for the purpose of illegal act.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.03.2017. There is no allegation of tampering of the witnesses alleged against the petitioner. He has
Patna High Court Cr.Misc. No.23380 of 2017 (2) dt.23-05-2017 2/2 got no criminal antecedent. He has falsely been implicated in the present case. The victim has been examined under Section 164 Cr. P.C. She has not supported the allegation made in the FIR rather she has admitted that she has got married with the petitioner and she wants to reside with the petitioner.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Manjhaul, Begusarai in connection with Cheriabariarpur P.S. Case No. 13/2017.
