JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,467,468 and 471/34 of the Indian Penal Code.
The prosecution case is that the informant claims the 20 decimals of land pertaining to Khata nos. 157,317 and 619 by virtue of a sale deed executed in his favour in 2013 but subsequently co accused Shivshankar Singh executed sale deed in favour of the petitioner though the informant claims to have given twenty thousand for getting the mutation done in her favour but the mutation was done in favour of the petitioner. It is submitted by the learned counsel for the petitioner that the petitioner claims to have purchased ten decimals of land
Patna High Court Cr.Misc. No.9068 of 2016 (2) dt.26-02-2016 2/2 from Shivshankar Singh, the grand son of late Ram Narayan Singh after making payment of the consideration amount and later on his name was mutated. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the accusation levelled in the background of civil nature of dispute, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Muzaffarpur in connection with Bochahan P.S. Case No.133 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
