This application, for grant of anticipatory bail, arises out of Patliputra Police Station Case No. 436 of 2018, disclosing offences under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code.

The petitioner was an applicant for RRB Group-D Examination. Allegedly, someone else was found appearing in the examination on the basis of the admit card which was issued in favour of the petitioner.

Learned Counsel appearing on behalf of the petitioner has submitted that the said co-accused, Deepak Kumar, has been granted regular bail by this Court by order dated 22.01.2019,

Patna High Court CR. MISC. No.12087 of 2019(2) dt.27-02-2019 2/2 passed in Criminal Misc. No. 2825 of 2019. He submits that the petitioner shall present himself before the police or the Court, as and when required and since the accusation is based on document, there is no chance of tampering with the evidence. Considering the facts and circumstances, this application is allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge - XII -cum- Additional Chief Judicial Magistrate, Patna, in connection with Patliputra Police Station Case No. 436 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
