2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 25 liters illicit liquor was recovered from the bag kept on a motorcycle of which petitioner is registered owner.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery.
5. Learned counsel appearing for the State opposes the prayer for bail and submits that there is recovery of illicit liquor from the motorcycle of which petitioner is registered
Patna High Court CR. MISC. No.15025 of 2025(2) dt.07-04-2025 2/2 owner and petitioner has got two criminal antecedent of similar nature, as such, he cannot be allowed privilege of pre-arrest bail.
6. Considering these facts, prayer for bail of the petitioner is refused.
