The petitioner seeks bail in connection with Nawada Town P.S. Case No. 200 of 2017 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 353, 188, 283, 337, 153A and 427 of the Indian Penal Code, Section 27 of the Arms Act and Section 3/4 of Explosive Substance Act. Prosecution case is that there was a communal riot. Two groups were brick-batting against each other. The petitioner is said to be a member of the one community. As per the F.I.R. more than five hundred unknown persons involved in the said riot. Submission on behalf of the petitioner is that the allegation levelled against him is not specific. Patna High Court Cr.Misc. No.23307 of 2017 (2) dt.29-05-2017 2/2 co-accused persons of this case have been granted bail vide order dated 17.05.2017 passed in Cr. Misc. No. 24018 of 2017 and 22.05.2017 passed in Cr. Misc. No. 24332 of 2017 respectively. The petitioner is in jail since 06.04.2017 having clean antecedent. Considering the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 200 of 2017.
