JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2019 Petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 1149(C) of 2018, in which cognizance has been taken under Section 498A IPC and Section 4 of Dowry Prohibition Act.
Allegation against the petitioners, who happen to be father-in-law and mother-in-law of the complainant, is of subjecting her to cruelty with respect to demand. Submission of learned counsel for the petitioners is that though specific allegation has been attributed against them but in her statement on S.A. shows that she is residing with her husband since 2015 and she does not want to live with the

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Patna, in connection with Complaint Case No. 1149(C) of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
