JUSTICE ANIL KUMAR SINHA ORAL ORDER 02-05-2023 The petitioner was appointed on the post of Physical Trained Teacher on 27-04-1985 in Government Middle School, Gobindpur in Matric Trained Scale. He was recommended for the National Teacher Award and on the occasion of Teacher Day in 2004 the petitioner was awarded with National Teacher Award by the Hon'ble President. As a result of grant of National Award a teacher is entitled for extension of service for three years as per resolution of the Government contained in resolution no. 10 / 2-2-2 / 81 Ed-1744 dated 25-11-1981

The petitioner retired in the year 2021. He has filed the present writ application seeking extension of service to the extent of three years as per the aforesaid resolution. Learned counsel for the petitioner submits that petitioner has filed representation before the District Education Officer, Nawada for extension of his service, which has been forwarded to the Director, Primary Education, Government of Biha, Patna. The representation of the petitioner is at Annexure7 of the present writ application. Accordingly, prayer is that the Director, Primary Education, Govt. of Bihar may be directed to dispose the representation of the petitioner in accordance with law.

Learned counsel for the State has got no objection in this regard.

Having heard learned counsel for the parties and taking into consideration the fact that representation of the petitioner is still pending before the respondent no. 3 / Director, Primary Education, Govt. of Bihar, Patna, accordingly, I direct the respondent no. 3 to dispose the representation of the petitioner in accordance with law by a reasoned order within a period of three months from the date of receipt / production of a
