The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B, 201, 120B and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant was tortured and killed by the accused persons including the petitioner herein who happens to be the elder brother of her husband.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case only for the reason that he happens to be the elder brother of the husband of the deceased. The allegations are general and omnibus in nature. The petitioner is in custody since 26.11.2020 and has no criminal antecedent. The husband of the

Patna High Court CR. MISC. No.23094 of 2021(4) dt.26-11-2021 2/2 deceased is in custody for the last about six months and his application for regular bail is pending in this Court vide Cr. Misc. No. 47680 of 2021.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the husband of the deceased being in custody and the petitioner having remained in custody for over 1 year, the petitioner is directed to be enlarged on bail in connection with Khaira P.S. Case no. 166 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui.
