JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State and learned counsel for the informant.

Petitioners apprehend their arrest in connection with Belsand Police Station Case No. 155 of 2014 registered for the offences punishable under Sections 147, 323, 341, 324, 379, 307, and 504 of the Indian Penal Code.

Petitioner no. 1 happens to be full brother of the informant. It is alleged that he assaulted the informant by means of sword and similarly petitioner no. 2 is said to have assaulted the informant by a dagger but submissions on behalf of the petitioners is that no sharp cutting injuries were found either on the person of

Patna High Court Cr.Misc. No.12017 of 2015 (2) dt.27-04-2015 2/2 informant or his wife and both the injured of this case sustained simple injuries, which is said to be caused by hard and blunt substance.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Belsand Police Station Case No. 155 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
