The petitioner seeks bail in Kishanpur P.S. Case No.41 of 2019, registered under Sections 366A/34 of the Indian Penal Code.

The informant alleged that the petitioner along with other accused persons kidnapped his daughter. Learned counsel for the petitioner submits that the victim made her statement under Section 164 Cr.P.C. and she disclosed her age to be 16 years but from the medical report it would appear that the victim is a major girl. From the statement of the victim itself, it would appear that the victim voluntarily moved all around along with the petitioner and other accused persons. She went to Delhi along with the petitioner but she did not raise any hue and cry all the way to Delhi. The petitioner is

Considering the facts and nature of allegations made against the petitioner and the fact that the petitioner is in jail since 28.07.2019, petitioner, namely, Suresh Yadav is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul in connection with Kishanpur P.S. Case No.41 of 2019.
