The petitioner has prayed for bail in a case registered for the offence punishable under sections 363, 365, 366A, 370, 370A, 372, 373, 376, 120B/34 of the Indian Penal Code and sections 3, 4, 5 and 6 of Immoral Traffic prevention Act, Section 4 and 6 of POCSO Act and Section 75 and 79 of J.J. Act. As per allegation in the FIR, on getting secret information about running of brothel at the house of the petitioner, a raid was conducted by the police officials and recovered some ladies with minor girls, objectionable items and cash and accordingly, seizure list was prepared and petitioner and others were arrested on spot. On query, minor girls disclosed their names and they also disclosed that they are forced to indulge in immoral trafficking by co-accused Rinki Devi.

The alleged place of occurrence is the joint family house. Arrested ladies and girls were distant relatives of the petitioner. Petitioner has no concern with the affairs of other co-accused. No incriminating article has been recovered from his conscious possession. Petitioner has got no criminal antecedent and he is languishing in judicial custody since 19.01.2023. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ADJ VI, Sitamarhi in connection with Sitamarhi P.S. Case No. 46 of 2023.
