====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 28-04-2026 Heard Mr. Sanjay Kumar Mishra, learned counsel appearing on behalf of the petitioner and Mr. Ram Bilash Roy Raman, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Maner P.S. Case No. 527 of 2024 registered for the offence punishable under Sections 140(1), 109, 61(2), 3(5) of the BNS and Section 27 of the Arms Act.

3. As per the allegation made in the FIR, petitioner along with other co-accused persons, had allegedly killed the husband of the informant.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is not named in the FIR, which is against altogether eight persons, however, due to inadvertence, in paragraph no. 4 of the bail application, he has

It is the case of the petitioner that name of the petitioner has been disclosed by the informant in her restatement and he admits that the husband of the informant has died, whose dead body has not been reocvered till date as per the report contained in Memo No. 2020/24 dated 20.03.2026 and Section 103(1) of the BNS was also added lateron.

5. Considering the nature of allegation against the petitioner, who with a common intention, had assaulted and killed the husband of the informant, I am not inclined to enlarge the petitioner on pre-arrest bail.

6. Accordingly, the present application stands dismissed.
