The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498A and other Sections of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.
The petitioner is husband of the informant. The informant made allegation that her husband subjected her to physical and mental torture.
It is submitted that the petitioner made all efforts to live with his wife, but his wife without any rhyme and reason use to leave the house of the petitioner. The petitioner filed divorce case on 18.12.2014 being Divorce Case No. 259 of 2014, thereafter the
Patna High Court Cr.Misc. No.19468 of 2015 (5) dt.03-11-2015 2/2 wife of the petitioner filed this case on 13.01.2015. Notice was issued to the wife of the petitioner, but even after service of notice the wife did not appear.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Buxar in Buxar (Mahila) P.S. Case No. 01 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
