The petitioner is languishing in custody since 15.05.2016 in connection with Rajeev Nagar P.S. Case No. 57 of 2016, G.R. No. 1588 of 2016, Sessions Trial No. 661/2016 for the offences instituted under Sections 498(A), 307 of the IPC., and additional Sections 304(B)/34 of the IPC and 3⁄4 of the D.P. Act. The prosecution story, in brief, is that the marriage of the informant was solemnized with one Bimal Chaudhary on 17.09.2013 and her father has given an amount of Rs. 3,50,000/- and other essential articles were also gifted in the marriage. After the marriage, her in-laws started to torture the informant, assaulted and ousted from her Sasural. She went on the roof of the house

Patna High Court Cr.Misc. No.23493 of 2017 (2) dt.24-05-2017 2/3 and when she came back on 16.02.2016 at 3.00 P.M. from roof and knocked the door of the room, all the accused came and this petitioner sprinkled Kerosene Oil on her body and her Nanad Jyoti Kumari lit the fire as a result of which, she sustained injury and thereafter she was admitted in PMCH.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.05.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. She has got no criminal antecedent. The petitioner is the mother-in-law of the deceased. She is separate in mess and property from the husband of the deceased. During the trial, the informant has been declared hostile vide Annexure-3 series to the present application. The other co-accused has been granted bail by another co-ordinate Bench of this Court vide Cr. Misc. No. 16400 of 2017. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IX, Patna, in connection with Rajeev Nagar P.S. Case No.
