The petitioner apprehends his arrest in a criminal prosecution registered under Sections 341, 307, 504 and 506/34 of the Indian Penal Code as also under Section 27 of the Arms Act. Taking into consideration the fact that the petitioner is specifically named in the FIR vide Annexure-1 as an accused with allegation of participating in the crime in question and further taking into consideration the fact that he is an accused in one more criminal case of serious nature, which finds mentioned in paragraph 3 of the anticipatory bail application, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for grant of anticipatory bail in connection with Narayanpur P.S. Case No.79 of 2015 pending in the court of Sri P.K. Pandey, learned Judicial Magistrate, Ara is rejected.
However, if the petitioner surrenders in the court below within a period of four weeks from today and applies for
Patna High Court Cr.Misc. No.13612 of 2016 (2) dt.09-05-2016 regular bail, then the same shall be considered and decided on its own merits without being prejudiced by the present order. (Birendra Prasad Verma, J) Arvind/- U T
