JUSTICE SANJAY PRIYA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sasaram (M) P.S. Case No. 962 of 2016 instituted for the offence under Sections-47, 47(A), 53(a), 53(b), 54 of the Bihar Prohibition and Excise Act, 2016. It has been submitted that illicit liquor has been recovered from premises of Kunwar Singh. As per written report, the informant got information that in the brick kiln, illicit liquor is being sold by this petitioner and other accused persons. Counsel for the petitioner submits that police has not made Kunwar Singh as accused in this case and this accused has falsely been implicated in this case. From the seizure list itself, it appears that there is no recovery from conscious possession of the petitioner. The petitioner is in custody since 20-02-2017.

No.24273 of 2017 (2) dt.24-05-2017 2/2 In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sasaram (M) P.S. Case No. 962 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram subject to condition that both the bailors should be close relatives of the petitioner.
