Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 457, 323, 354 of the Indian Penal Code and 3(1) (x) (xi) of the S.C./S.T.(Prevention of Atrocities) Act.
The prosecution case is that the petitioner entered into the house of the informant and outraged the modesty of the informant. When informant raised alarm, the petitioner committed teeth bite. When the son of the informant came to rescue, the petitioner escaped from the scene. It is submitted by the learned counsel for the petitioner that for a petty dispute accusation has been levelled. Though the First Information Report was registered on 02.12.2015 but the same reached to the court of learned
Patna High Court Cr.Misc. No.8713 of 2016 (2) dt.24-02-2016 Additional Chief Judicial Magistrate on 07.02.2015 which suggests that First Information Report was registered by ante dating. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Dehri S.C./S.T. P.S. Case No. 43 of 2015, pending in the court of learned Additional District & Sessions Judge-IVth, Sasaram, Rohtas.
With this observation this application is disposed of.
