The petitioner has been in custody since 14.10.2017 in connection with Motihari (Muffasil) P.S. Case No. 531/2017 registered for the offences punishable under Sections 387 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is wholly false and fabricated and has been lodged at the instance of Narayan Das (informant of Piprakothi P.S. Case No. 28 of 2016), who is the father of the girl with whom the petitioner has alleged to have absconded at one point of time. The said case lodged by the informant was quashed by this Court in a Criminal Writ Application and, therefore, only to implicate him further, the present story of Rangdari has been concocted. Learned counsel for the petitioner further submits that he had lost his mobile on a previous date and in support thereof he has filed an affidavit dated 05.10.2017 stating that the mobile in

Patna High Court Cr.Misc. No.7972 of 2018 (3) dt.05-03-2018 2/2 question had been lost. He next submits that on account of vendetta the present case has been lodged against the petitioner. Considering the history of the enmity between the parties and that the petitioner has already been in custody for more than four months, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, in connection with Motihari (Muffasil) P.S. Case No. 531/2017.
