The petitioners seek regular bail in connection with Nautan P.S. Case No. 476 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 41 liters of illicit liquor from the petitioners.

The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case. It is submitted that as far as the petitioner no. 2 is concerned, he is having a clean antecedent while the petitioner no. 1 is accused

Patna High Court CR. MISC. No.12486 of 2019(2) dt.01-03-2019 2/2 in one other case in which he is on bail. Lastly, it is submitted that the petitioners are languishing in custody since 16.09.2018. Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, DistrictWest Champaran in connection with Nautan P.S. Case No. 476 of 2018.
