2. The petitioner seeks bail in connection with Lakhisarai Cyber P.S. Case No. 75 of 2024 instituted for the offences under Sections 308(2), 308(3), 74, 77, 79, 352, 351(3) of the BNS and Sections 67/67A of the Information Technology Act.

3. Prosecution case, in short, is that this petitioner manipulated the photo of the informant's daughter and also made it viral. It is further alleged that the petitioner demanded Rs. 1 lakh from the informant and also threatened her and her family members.

4. Learned counsel for the petitioner submitted that the

Learned counsel further submitted that no video or photograph has been recovered from the mobile of this petitioner. Learned counsel further submitted that victim girl is the cousin of the petitioner. Learned counsel further submitted that both the parties are gotias and have land related conflict and therefore the petitioner has falsely been implicated in this case only to put pressure upon the family members of the petitioner. Police after investigation submitted charge-sheet against the petitioner under Sections 77, 79, 352, 351(3) of the BNS and Sections 67/67A of the I.T. Act. It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.11.2024 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, charge-sheet already being submitted against the petitioner as also the period of custody undergone by him, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court

Patna High Court CR. MISC. No.14416 of 2025(2) dt.17-03-2025 3/3 below/concerned Court in connection with Lakhisarai Cyber P.S. Case No. 75 of 2024, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner.

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.

(III) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
