The petitioners are languishing in custody since 04.10.2018 in connection with Beur P.S. Case No.335 of 2018 registered for the offences punishable under Sections 379, 414, 511 of the Indian Penal Code.
Prosecution case as per the written report of Pramod Singh, Sub Inspector of police Beur P.S. is to the effect that the informant was checking the visitors who had come to Beur Jail, Patna for meeting the prisoners when two boys came there on a motorcycle and parked the motorcycle near the wall and started looking here and there in suspicious condition and thereafter both of them started checking the lock of the other motorcycles being parked there by using the master key. Patna High Court CR. MISC. No.13366 of 2019(2) dt.07-03-2019 2/2 apprehended both of them and from their possession, altogether six master keys were recovered. The informant also recovered the stolen motorcycle from the possession of the said two persons. They further confessed that they have stolen dozens of motorcycles and they also confessed about commission of several other thefts. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and only on the basis of the statement of co-accused, they have made accused in the present case. It is submitted that co-accused, Sunil Kumar, has been granted bail by a Coordinate Bench of this Court vide order dated 14.02.2019 passed in Cr. Misc. No.6889 of 2019. It is further submitted that the petitioners are accused in two cases in similar nature.
Considering the nature of accusation and the fact that investigation has already been concluded and the period of custody, let the above named petitioners be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Beur P.S.
