JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-08-2022 At the outset, counsel for petitioner seeks permission to add section 420 in para 1 of the petition. Permission is granted and the same be done during course of the day.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in Raghopur P.S. Case No. 125 of 2021, registered for the offences punishable under Sections 413, 414, 120 and 34 of the Indian Penal Code. On the disclosure made by the co-accused Anjay Kumar this petitioner has been made accused in this case and it is alleged that this petitioner and others involved in sale and purchase of stolen motorcycles.

Name of this petitioner surfaced in this case on the basis of confessional statement of co-accused. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Vaishali at Hajipur in connection with Raghopur P.S. Case No. 125 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
