The petitioners apprehend their arrest in Baunsi P.S. case No. 307 of 2017 under Section 307 and other Sections of the Indian Penal Code. Later on Section 302 of the IPC was added. The informant alleged that while she had gone to keep fire wood the petitioners came and asked that the land belonged to them. They asked the informant not to keep fire wood. It is alleged that petitioners assaulted the informant and her fatherin-law, Jageshwar Manjhi. The learned counsel for the petitioners submits that there is no injury on the person of informant. The father-in-law of informant died his natural death as it appears from perusal of post

Patna High Court Cr.Misc. No.17908 of 2018 (2) dt.06-04-2018 2/2 mortem report (Annexure-2) that no external injury was found on his body. The doctor has specifically opined that death appears to be natural due to disease of kidney and lever. Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that the deceased died his natural death on account of disease of kidney and lever, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Baunsi P.S. case No. 307 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
