JUSTICE ARUN KUMAR ORAL ORDER 28-03-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody seek bail in Kurtha PS Case No. 3 of 2016 registered under Sections .147, 149, 302 and 201/34 of the IPC.
The allegation in brief is that the informant's son had gone to nearby village for taking liquor where quarrel took place with the villagers and the informant learnt that the accused persons named in the FIR killed his son and threw the dead body into a well. Learned Counsel for the petitioners submits that the informant is not the eye witness, there is no specific allegation against the petitioners, similarly situated other co-accused Gorakh Manjhi and others have been granted bail by coordinate Bench of this Court in Cr. Misc. No. 25085 of 2016 and Cr. Misc. No. 6735 of 2018.
Having considered the said facts and circumstances, the petitioners, namely, Kamlesh Manjhi, Mukesh Manjhi, Sunny Manjhi, Ranjan Manjhi and Manoj Manjhi are is directed to be
Patna High Court Cr.Misc. No.17907 of 2018 (2) dt.28-03-2018 released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of CJM Arwal in connection with Kurtha PS Case No. 3 of 2016.
