JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-06-2019 Heard Mr. Chitranjan Sinha, learned senior counsel for the petitioner and learned A.P.P. for the State. The petitioner seeks bail in connection with Ashok Paper Mills P.S. Case No. 116 of 2018 registered under Sections 307, 120B/34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case on the basis of confessional statement of the petitioner and there is no other material on the record against the petitioner. It is further submitted that two miscreants came and shot fire and then my brother Lal Bihari Yadv, Arun Yadav injured and fell down. It is further submitted that injured person came to D.M.C.H. and after treatment, D.M.C.H. referred to Paras
Patna High Court CR. MISC. No.14293 of 2019(3) dt.25-06-2019 2/2 Hospital. The petitioner is in custody since 25.10.2018. There is no specific allegation against the petitioner and the petitioner has been falsely implicated only on the basis of confession before the police.
In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Ashok Paper Mills P.S. Case No. 116 of 2018.
