The present petition has been filed for quashing the order dated 14.07.2015, passed by learned Sub-divisional Judicial Magistrate, Madhubani in Ladaniyan PS case no. 49/2012 (Tr. no. 132/14), whereby and whereunder the learned Trial Court has refused to discharge the petitioner from the offence punishable under Section 7 of the Essential Commodity Act.

The learned counsel for the petitioner submits that since the charges have already been framed and the trial is going on, the present petition has been rendered infructuous, however, the petitioner be granted liberty to raise all the issues raised in the present petition, before the learned Trial Court at an appropriate stage. Liberty so sought, is granted.
