JUSTICE SANJAY PRIYA ORAL ORDER 23-05-2017 Heard learned counsel for the petitioners and the State. Petitioners seek bail in Phulparas P.S. Case No. 381 of 2016 instituted for the offence under Sections-458, 380, 411 of the Indian Penal Code.

It is alleged in the written report that in the night, hearing the barking of dogs, the informant wake up and found that two cattle were being taken away by these petitioners from his cattle shed. The informant informed the police and both these accused persons were handed over to the police. Seizure list has been enclosed with the FIR. The seizure list does not bear signature of these petitioners whereas; as per written report, these petitioners were caught red handed with two cows of the informant. Petitioners are said to be in custody since 01-01-2017.

No.23720 of 2017 (2) dt.23-05-2017 2/2 In such circumstances, the prayer for bail is allowed and the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Phulparas P.S. Case No. 381 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani subject to condition that both the bailors should be close relatives of the petitioners.
