The petitioner apprehends his arrest in connection with Khutauna P.S. Case No. 133 of 2018 for the offence punishable under Section 7 of the E.C. Act, Sections 379, 411, 409, 120 of the Indian Penal Code and 37(b) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the petitioner happens to be elected Mukhiya of his Gram Panchayat and on account of political rivalry he has falsely been made accused in this case. Nothing has been recovered from the conscious possession of the petitioner.

Considering the facts and circumstances of the case, let the above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IIIrd, Jhanjharpur (Madhubani) in connection with Khutauna P.S. Case No. 133 of 2018 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
