This is an application for bail in connection with Sessions Trial No. 156 of 2017, arising out of Bihta P.S.Case No. 696 of 2016 registered for the offences punishable under Sections 341, 504, 506, 324 and 302 of the Indian Penal Code. Allegation against the petitioner is that he in intoxicant condition started abusing the informant and when father of informant came petitioner stabbed him causing injury on his chest and during treatment he died.

It has been submitted on behalf of the petitioner that there is no repetition of blow and further occurrence took place in the spur of moment and there is no intention to kill him and he is in custody since 24.9.2016.

Patna High Court Cr.Misc. No.23536 of 2017 (2) dt.17-05-2017 2/2 Having heard both sides and in view of direct allegation against the petitioner of stabbing and causing death of the deceased, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody for the last seven month, learned trial court is directed to expedite the trial of the petitioner.

Accordingly, this application is dismissed.
