Petitioner seeks bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he is not named in the FIR. He has been falsely implicated in this case. His name has surfaced in course of investigation only on suspicion. Widow of deceased changed her version one after another. He is in custody since 23.07.2018 having no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with

Patna High Court CR. MISC. No.12712 of 2019(3) dt.08-05-2019 2/2 two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dhangai Police Station Case No.20 of 2018, Sessions Trial No.404 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
