By the impugned order, the learned court below has rejected the petition filed on behalf of the plaintiff-petitioner for withdrawal of the suit with a liberty to file a fresh suit. The learned court below by the impugned order has turned down the said prayer. The learned counsel for the petitioner, after some argument, has submitted that the prayer on behalf of the petitioner for simple withdrawal of the suit may be allowed. The learned counsel for the other side has raised no objection to the said prayer for simple withdrawal of the suit. In view of the aforesaid stand taken by the learned counsel for both the parties, this application is disposed of

Patna High Court CWJC No.13069 of 2013 dt.12-01-2017 allowing the prayer of the plaintiff-petitioner for withdrawal of Eviction Suit No.03/1993 pending before the court of learned Additional Munsif VIII, Munger and the impugned order passed by the learned court below is altered to that extent.
