This application for grant of regular bail arises out of Isuapur P.S. Case No. 258 of 2019 registered for the offence punishable under Sections 420, 467, 468, 471, 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
Allegedly, from a truck police recovered 2008.800 litres of illicit liquor. The petitioner was arrested on the spot, who was the driver of the vehicle.
Learned counsel appearing on behalf of the petitioner has submitted that similarly circumstanced other persons have been allowed bail.
I am not convinced with the submission made on
Patna High Court CR. MISC. No.18184 of 2020(3) dt.09-07-2020 2/2 behalf of the petitioner that the persons, who have been allowed bail, are similarly situated. The petitioner was allegedly found in possession of huge quantity of illicit liquor in a truck which he was driving.
Considering the seriousness of the offence, I do not consider it to be a fit case for grant of regular bail for the present.
This application is accordingly rejected.
Petitioner will be at liberty to renew his prayer for regular bail after six months, if, in the meanwhile, there is no substantial progress in the trial.
