Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 318(4), 338, 336(3), 340(2) of the Bhartiya Nyaya Sanhita. 3.

Learned counsel for the petitioner submits that in sum and substance, the allegation against the petitioner is that she obtained appointment as a teacher based on certificate of one Priyanka Kumari. It is next submitted that petitioner had earlier moved before this Court seeking anticipatory bail by filing Cr. Misc No. 24321 of 2024 and the same was allowed by an order dated 23-7-2024. It is further submitted that the instant FIR has been instituted by the District Programme Officer (Establishment), Buxar, wherein he has alleged that the

No.12908 of 2025(2) dt.02-04-2025 2/3 petitioner sought appointment as teacher based on the certificate of another Priyanka Kumari and as such it was found that the petitioner was not entitled for the job hence an order was also passed to recover an amount of Rs. 4,93,008/- from the petitioner which was paid to her by way of salary. 4.

Learned counsel for the petitioner next submits that petitioner has been falsely implicated in the instant case by the authority even without holding a proper investigation. It is further submitted that petitioner had earlier moved this Court seeking anticipatory bail on the allegation that she got appointment as teacher based on certificate of Priyanka Kumari, in which the petitioner was granted privilege of anticipatory bail as such the learned counsel submits that in the instant case also the privilege of anticipatory bail be granted to the petitioner. It is also submitted that petitioner will not abscond rather will cooperate in the investigation to prove her innocence. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.12908 of 2025(2) dt.02-04-2025 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dumraon P.S. Case No. 361 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
