JUSTICE PARTHA SARTHY ORAL ORDER 24-06-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner who is in custody since 20.11.2019 has filed the instant application for grant of regular bail in connection with Araria P.S Case no. 676 of 2019 (G.R. no. 2996/2019) registered under sections 188 and 414 of the Indian Penal Code and sections 44, 45(12) and 46 of the Prison Act. As per allegation in the FIR, it is stated that when the petitioner had been taken for his production in Court in connection with another case it transpired that he had come in possession of a mobile phone and as such the instant case. It is submitted by learned counsel for the petitioner that the allegation as levelled in the FIR are false and concocted and he has been falsely implicated in the case. He is in custody

The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Araria P.S. Case no. 676 of 2019 (G.R. no. 2996 of 2019) on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria (Partha Sarthy, J) Prakash/- U
