====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-11-2021 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners seek bail in connection Banmankhi P.S. Case no. 269 of 2020 registered for the offence punishable under sections 323, 353, 346, 367, 368, 370, 370(a), 372, 373, 376, 120B of the Indian Penal Code, sections 4, 6, 12, 17 of POCSO Act read with sections 3, 4, 5, 6 of the I.T Act and sections 75 and 79 of J.J. Act.

Learned counsel for the petitioners at the outset submits that petitioners are persons with clean antecedent and are in custody since 19.10.2020 and charge sheet has been submitted. Learned counsel for the petitioners further submits that from

No.22962 of 2021(2) dt.16-11-2021 2/2 perusal of the allegation as alleged in the FIR, it would manifest that informant has received information about flesh trade in the house of Nizam @ Noor Alam and when house was raided large number of persons including petitioners were arrested. Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the FIR, it would manifest that against petitioner no.1, it is alleged he was also present there and disclosed the names of the persons who fled away and so far as petitioner no.2 is concerned, no specific allegation has been alleged against her.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioners are persons with clean antecedent and charge sheet has been submitted, the petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge VI, Purnea in Banmankhi P.S. Case no. 269 of 2020. (Satyavrat Verma, J) s.hassan/- U T
