JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
The FIR of the occurrence of murderous assault is against unknown. The petitioner is in custody since 07.09.2015 mainly for the reason that the petitioner is carrying several criminal cases against him.
Submission is that even after completion of investigation only material against the petitioner is suspicion. Considering the period already undergone, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.16939 of 2018 (2) dt.28-03-2018 P2/ bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bairiya P.S. Case No.151 of 2011, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. Both the bailors shall be resident of within the territorial jurisdiction of Court-below.
