The petitioner seeks bail in Ghoshi P.S. Case No. 367 of 2016 registered under Sections 25(1-b)a and 26 of the Arms Act.

The petitioner was apprehended and from his possession, one country made pistol and eight live cartridges of .315 bore were recovered.

Leanred counsel for the petitioner submits that the recovery is planted. Chaukidars are the witnesses of the seizure list. The petitioner is in jail since 22.12.2016. Petitioner has already remained in jail for more than 41⁄2 months. He has got no criminal antecedent.

Considering the facts aforesaid that the petitioner
