The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 342, 354, 504, 506 of the Indian Penal Code and Section 3(i)(r) (wi)/3(ii)(VA) SC/ST Act and Section 8 of the POCSO Act. The allegation against the petitioner is that he outraged the modesty of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to enmity and village politics. He has got no criminal antecedent. The present case is counter blast on account of enmity with the family of the informant. It is further submitted that the informant has not stated in what manner her modesty has been affected. As per

Patna High Court CR. MISC. No.14866 of 2023(2) dt.09-05-2023 2/2 medical report, no any type of injury and no evidence of sexual assault was found on her body which show contradiction in the statement of victim girl (informant) recorded u/s 161 Cr.P.C. and 164 Cr.P.C. The petitioner is languishing in judicial custody since 16.01.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Simri P.S. Case No. 230 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeVI-cum-Special Judge, POCSO Court Act, Buxar.
