The petitioner apprehends his arrest in Aurai P.S. Case No. 217 of 2020, registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner along with other FIR named accused persons committed murder of the son of informant. It is alleged that one month prior to the alleged occurrence, petitioner along with others have threatened the informant and his son with dire consequence.

It is submitted that petitioner has been made accused in this case only on suspicion. Petitioner is co-villager of the informant and there is no specific allegation against the petitioner. Petitioner claims clean antecedent.

Patna High Court CR. MISC. No.12653 of 2022(2) dt.16-08-2022 2/2 However, counsel for State opposed the prayer for bail and submitted that petitioner is named in the FIR and there is specific and direct allegation that petitioner along with others committed murder of the son of informant.

Considering the facts aforesaid, nature of accusation and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail.

Accordingly, the prayer for anticipatory bail is rejected.
