JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Heard learned counsels for the petitioner and the State. The petitioner, being father-in-law of the victim, is apprehending arrest in a case registered for the offences punishable under Section 328, 302/34 of the Indian Penal Code. The prosecution case is that the informant's daughter, Savita Devi, was forcibly administered poison by the petitioner and Suman Gond, brother of the husband of victim. It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled. The victim died after 10 years of the marriage and during post mortem examination no injury has been found and viscera has been preserved for forensic examination. Statement has been made in

Patna High Court Cr.Misc. No.7245 of 2016 (2) dt.18-02-2016 2/2 paragraph 9 of the petition to that effect, which reads as follows:- "9. That the doctor who conducted the post mortem of the deceased did not find any injury on the person of the deceased. However, the viscera of the deceased was preserved for sending it to F.S.L. for chemical examination and opinion regarding cause of death."

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, West Champaran at Bettiah in connection with Yogapatti (Nawalpur) P.S. Case No. 247 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
