Petitioner apprehends his arrest in connection with R.P.F./Post Bhagalpur Case No. 1361 of 2017 registered for the offences punishable under Section 143(i) of Railway Act. Allegation against the petitioner is of utilizing his user I.D. and purchasing of 78 e-ticket which is in violation of RTC Rules.

Submission of learned counsel for the petitioner is that for the period from 20.2.2016 to 23.11.2017 he was entitled for purchase of 126 e-tickets, whereas allegation is of purchasing of 78 e-tickets and there is no other allegation against him. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.14116 of 2018 (2) dt.10-04-2018 2/2 circumstances, let the petitioner, above named, surrender within a period of four weeks and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway, Bhagalpur, in connection with R.P.F./Post Bhagalpur Case No. 1361 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner shall co-operate in investigation, otherwise prosecution will be at liberty to move for cancellation of his bail bond.
