JUSTICE ARUN KUMAR ORAL ORDER 19-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Mithanpura PS Case No. 274 of 2017 registered under Sections 302 and 120B/34 of the IPC.
The allegation in brief is that the deceased had illicit affairs with wife of one of the co-accused Md. Guddu and the allegation is that Guddu and Saleem called him in the evening and went away with the deceased near the high school and on hearing alarm raised by him the informant went there and saw this petitioner and Guddu running away and found dead body of her son.
Learned Counsel for the petitioner submits that the petitioner has no criminal antecedent and merely on suspicion has been made accused.
Learned Counsel for the State submits that this petitioner had taken away the deceased and the informant after hearing alarm went there and saw this petitioner running away along with some other persons.
Having considered the said facts and circumstances, the petitioner, namely, Md. Saleem is directed to be released on bail on
Patna High Court Cr.Misc. No.1712 of 2018 (4) dt.19-02-2018 furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM , East, Muzaffarpur in connection with Mithanpura PS Case No. 274 of 2017.
