2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 191(2), 190, 126(2), 115(2), 109, 352, 351(2) and 103(1) of the B.N.S.

3. The case of the prosecution is that the petitioner along with four accused persons being armed with lathi, danda and sharp cutting weapon started assaulting the son of the informant. It is further alleged that due to those injuries, the victim died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that there is also a counter version of this case. It has also been submitted that both parties have received injuries. From perusal of the injury report, it is clear

It has also been submitted that the nature of allegation is general and omnibus. There is no specific allegation as to who has assaulted with which weapon to the deceased. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. It has also been submitted that co-accused Rahis Bind has been granted bail by this Court vide Cr. Misc. No. 48307 of 2025. The case of this petitioner stands on similar footing. Moreover, he is languishing in judicial custody since 28.06.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gaurichak P.S. Case No. 726 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Patna City, Patna.
