JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-01-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Amnour P.S. Case No.62 of 2015 registered under Sections 147, 148, 149, 323, 341, 342, 337, 353, 427, 393, 448, 504, 506, 307 and 511 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that due to enmity name of the petitioner has been given in the FIR without disclosing his parentage and other details. He submitted that he is a labourer and earns his livelihood outside the State in Gujarat. In the alleged incident no body sustained any injury and no property was looted.

Learned counsel for the State has opposed the prayer for

Patna High Court Cr.Misc. No.1419 of 2018 (2) dt.19-01-2018 2/2 grant of pre-arrest bail to the petitioner.

Regard being had to the nature of allegation and the observations made by the learned 1st Additional Sessions Judge, Saran, Chapra vide order dated 10.08.2017 in A.B.P. No.2128 of 2017, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Saran, Chapra in connection with Amnour P.S. Case No.62 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
