The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code and Sections 3, 4, 5 and 6 of the Bihar Conduct of Examination Act, 1981.

The allegation against the petitioner is that coaccused, Nitish Kumar, disclosed that the examinees were called at village Akalibad where the question papers were given to them.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is allegation that the name of the

No.13054 of 2022(2) dt.05-09-2022 2/2 petitioner was disclosed by co-accused Nitish Kumar and others that he had provided question papers but the allegation is false against the petitioner as no any incriminating articles have been recovered from the conscious possession of the petitioner. Petitioner has clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Hajipur, Vaishali in connection with Hajipur Sadar P.S. Case No. 303 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
