The petitioner seeks bail in a case instituted under Sections 379, 414/34 of the Indian Penal Code and Sections 25(1B)a, 26 & 35 of the Arms Act. The petitioner is the owner of the truck on which the theft electricity wire is said to have been transported. It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.03.2017. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is the owner of the truck on which theft electricity wire was being transported. The petitioner had no knowledge regarding the goods being a stolen property.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kishanganj in connection with Pothiya P.S.
