Petitioner, already in custody, seeks bail in connection with Saraiya P.S. Case No.293 of 2017 (Trial No.712 of 2017), registered under Section 307 of the Indian Penal Code as well as under Sections 25(1-b)a, 26, 27, 35 of the Arms Act. Allegation in brief is that the police on suspicion made an attempt to apprehend two persons Ramanuj Sahi and this petitioner, Ramanuj Sahi opened firing on the police personnel and escaped away but the petitioner was apprehended and one country made pistol, four live cartridges with one magazine were recovered from possession of the petitioner. Learned counsel for the petitioner submits that it is a case of simple recovery of one country made pistol with four live

Patna High Court Cr.Misc. No.17926 of 2018(2) dt.29-03-2018 2/2 cartridges and the petitioner is in custody for last eight months; whereas learned counsel for the State submits that the petitioner has criminal antecedent of four cases including cases of Arms Act and robbery.

Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Saraiya P.S. Case No.293 of 2017 (Trial No.712 of 2017), pending in the court of learned Sub-Judge, 1st-cum-ACJM, 1st (West), Muzaffarpur with a direction to the trial court to expedite the trial.
