The petitioner seeks bail in connection with Kudhani P.S. Case No. 108 of 2016, registered under Section 392 and 411 of the Indian Penal Code.

The accusation is that informant's Scorpio vehicle was hired by three persons on 07.04.2016 for Chhajam Chowk. When informant proceeded for destination then the person, who was sitting on rear seat pointed pistol and other spread chilli powder then informant any how jumped to the vehicle and they succeeded to move with the vehicle. The informant gave information regarding theft of the vehicle and on search the vehicle was found parked at line hotel, where two persons were found sleeping, who disclosed their names as Kundan Kumar

Patna High Court Cr.Misc. No.23897 of 2017 (3) dt.28-06-2017 2/2 and Md. Aslam. On enquiry, they also disclosed the name of this petitioner having hand in the robbery of the vehicle. Learned counsel for the petitioner submits that the name of the petitioner has surfaced in the confessional statement of co-accused Kundan Kumar, who has been apprehended from the said vehicle. Further submission is that co-accused Kundan Kumar and Md. Aslam have been granted bail by a co-ordinate Bench of this Court on 04.04.2017 and 15.02.2017 passed in Criminal Miscellaneous No.7678 of 2017 and Criminal Miscellaneous No. 3323 of 2017, respectively. The petitioner is in custody since 29.09.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Muzaffarpur in connection with Kudhani P.S. Case No. 108 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
