JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 04-09-2021 Learned counsel for the petitioner undertakes to remove all the defects pointed out by the Stamp Reporter within four weeks after start of normal functioning of the Court. Heard Mr. Aditya Pandey learned counsel for the petitioner and Mr. Akhileshwar Dayal, learned APP for the State.
Petitioner in the present case is seeking regular bail in connection with Manjhi P.S. Case No. 340 of 2020 registered for the offence punishable under Sections 341, 323, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. He is in custody since 24.11.2020.
As per the prosecution story one Nawtanki Singh @ Pranav Singh was firing by an illegal weapon on the Chhat Ghat
Patna High Court CR. MISC. No.23662 of 2021(2) dt.04-09-2021 2/3 and he was being assisted by some of the co-accused who are named in the FIR. In the FIR one Bambhola Singh has been identified as the person who was assisting said Nawtanki Singh co-accused and nearby the said place co-accused Rohit Singh @ Golu Singh and Bholu Singh were seen standing who were also helping Nawtanki Singh. The FIR further states that because the firing made by the co-accused Nawtanki Singh several persons suffered injury and one of them is Golu Kumar Singh son of Tara Singh (this petitioner).
Learned counsel submits that this petitioner is one of the victim of the alleged offence and he has been named as injured in the FIR itself. The allegation of firing is against coaccused Nawtanki Singh and Bambhola Singh and there is no allegation of firing against this petitioner. He has no criminal antecedent.
Learned APP for the State is present and is unable to controvert the submission of learned counsel for the petitioner. In the facts and circumstances of the case stated hereinabove, this Court directs release of the petitioner on bail on furnishing bail bonds of Rs. 25000/- (Rupees Twenty Five Thousand Only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIIth, Saran, Chapra in
Patna High Court CR. MISC. No.23662 of 2021(2) dt.04-09-2021 3/3 connection with Manjhi P.S. Case No. 340 of 2020, subject to the conditions as laid down under Section 437(3) Cr.P.C. And condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
The application stands allowed.
