JUSTICE SANJAY PRIYA ORAL ORDER 28-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chiksaura P.S. Case No. 19 of 2017 instituted for the offence under Sections-461 and 379 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that stolen articles have not been put on TIP. Only suspicion has been raised against the petitioner In the written report, it is alleged that the informant went to his house to take meal and when he returned to his Boring at about 8.30 p.m. he saw this petitioner and co-accused taking away his electric motor. When the informant reached to his Boring, he saw that his motor was not there. The informant tried to chase but both the persons managed to run away.

Patna High Court Cr.Misc. No.32003 of 2017 (3) dt.28-07-2017 From the written report, it appears that the petitioner was not caught on the spot and mere suspicion has been raised against the petitioner.

In such circumstances, prayer for bail is allowed. The petitioners named above are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chiksaura P.S. Case No. 19 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate-I, Hilsa, Nalanda subject to condition that both the bailors should be close relative of the petitioner.
